Scope

Authorizes, on or after September 17, 2026, transactions related to, the provision of financing for, and other dealings in the Petróleos de Venezuela, S.A. 2020 8.5 percent bond that would otherwise be prohibited by subsection 1(a)(iii) of E.O. 13835. Replaces and supersedes GL 5X in its entirety effective August 3, 2026, moving the effective date from August 4 to September 17, 2026. Until then no authorization is in effect: the sale or transfer of the CITGO Holding shares pledged against the bond remains prohibited absent a specific OFAC license.

OFAC emitió la GL 5Y el 3 de agosto de 2026, un día antes de que la GL 5X entrara en vigor, y movió la fecha de efectividad de la autorización sobre el bono PdVSA 2020 8,5% del 4 de agosto al 17 de septiembre de 2026. La FAQ 595, actualizada el mismo día, confirma que entre el 24-oct-2019 y el 17-sep-2026 no rige ninguna autorización frente a la subsección 1(a)(iii) de la E.O. 13835, por lo que la venta o transferencia de las acciones de CITGO ligadas al bono permanece prohibida salvo licencia específica.
Implication
Es la tercera emisión consecutiva con ventana de mes y medio —5W (4-may → 19-jun, 46 días), 5X (18-jun → 4-ago, 47 días), 5Y (3-ago → 17-sep, 45 días)—: el ciclo corto es el régimen de trabajo, no la excepción. El colateral de CITGO Holding sigue fuera del alcance de una ejecución de los tenedores mientras el traspaso de PDV Holding a Amber Energy (afiliada de Elliott), aprobado por el tribunal federal de Delaware, depende de autorizaciones regulatorias que incluyen a OFAC. General License No. 5Y — Authorizing Certain Transactions Related to the Petróleos de Venezuela, S.A. 2020 8.5 Percent Bond on or After September 17, 2026

(a) Except as provided in paragraph (b) of this general license, on or after September 17, 2026, all transactions related to, the provision of financing for, and other dealings in the Petróleos de Venezuela, S.A. 2020 8.5 Percent Bond that would be prohibited by subsection 1(a)(iii) of Executive Order (E.O.) 13835 of May 21, 2018, as amended by E.O. 13857 of January 25, 2019, and incorporated into the Venezuela Sanctions Regulations, 31 CFR part 591 (the VSR), are authorized.

(b) This general license does not authorize any transactions or activities otherwise prohibited by the VSR, or any other part of 31 CFR chapter V.

(c) Effective August 3, 2026, General License No. 5X, dated June 18, 2026, is replaced and superseded in its entirety by this General License No. 5Y.
