A SOFA does not deploy troops: according to the State Department, it provides a legal framework for agreed activities, such as exercises or humanitarian assistance; the size and location of any deployment would be settled later. What changes is the horizon: the acting government would negotiate it ahead of elections with no date. And it will face a second check: from January 3, a Democratic Senate will be able to subpoena testimony on that agreement, which State has already briefed congressional aides on. The test is Caracas’s response, which had not come by press time, and the fourth round of the dialogue between the government and the opposition, November 11 to 15, will show whether the issue enters that negotiation. The financing runs on a separate track, Treasury’s and the multilaterals’.

If the central bank confirms it, it would be below May’s 6.3%, the lowest of the months it has published since April. The official rate rose 3.5% in October, from 859.06 to 889.26 bolívars per dollar; in September it had risen 8.1%, almost the same as prices. With prices up 6.2% and the official dollar up 3.5%, what is paid in bolívars became about 2.6% more expensive measured in dollars in a single month. The test is the central bank’s October price index.

The State Department is negotiating with Delcy Rodríguez’s government an agreement that would give a legal basis to a long-term U.S. military presence, according to U.S. officials.

EVENTO

Unidentified U.S. officials said on Tuesday the 3rd that the State Department is leading the negotiation of a status of forces agreement with Venezuela, and that troop numbers and locations would come in later agreements. In late October, the department briefed congressional aides. An unidentified senior department official said in Caracas there are no talks about bases. Caracas has not confirmed it: its embassy in Washington did not reply.

An agreement of this kind does not deploy troops: according to the State Department, it provides a “clear, predictable” legal framework for agreed activities such as ship visits, training, exercises and humanitarian assistance. On Friday, October 30, the armed forces struck an ELN site in Apure, with at least 23 dead according to Fundaredes; four unidentified U.S. officials say Washington provided intelligence and drones, and a senior Venezuelan officer confirmed the armed forces carried it out. The readout of Rubio’s meeting with Foreign Minister Blanco on Monday the 2nd does not mention the negotiation.

The acting president said on Tuesday the 3rd, before the industrialists’ confederation Conindustria, that $17 billion in financing over five years is being closed in a European country she did not name.

EVENTO

At Conindustria’s annual congress on Tuesday the 3rd, Delcy Rodríguez said the vice president for the economy made a “lightning trip to a country in Europe, where negotiations are being closed” for Venezuela to receive, over the next five years, $17 billion for the public and private sectors. She added that “we are sitting with the multilaterals” to decide which productive sectors get credit, not consumption, and that the tax reform “will be ready in the coming days.” She did not name the country, the instrument or the terms.

The World Bank offers up to $5 billion over two years, pending Venezuela clearing its arrears with other institutions; with the IDB they exceed $2 billion. On Tuesday the 3rd the foreign minister spoke with Qatar about investment and the Qatar Airways route, which lands in Caracas on Wednesday the 4th; the official note does not mention the IDB. Democrats won a majority in the U.S. Senate on Tuesday the 3rd, according to AP projections; networks also project the House. The new Congress takes office on January 3.

EVENTO

According to NPR’s tally of AP projections, Democrats won the Senate by flipping, among others, Iowa, Kansas, North Carolina, Ohio, South Carolina and Texas. CBS, NBC and CNBC also project the House, which AP had not yet projected. The outgoing Congress sits until January 3. The two bills to audit Venezuelan oil money, S. 3838 and H.R. 7819, have sat in committee since February and March.

The August oil agreement, Executive Order 14,373 and the status of forces negotiation are executive acts. Under the order and General License 52C, payments by U.S. companies to the Venezuelan state go to a Treasury account, and the order authorizes, without requiring, reports to Congress. With the majority, committees can subpoena testimony: NPR expects “a long list of investigations.” In January, the Republican Senate blocked 51-50, on Vance’s tie-breaking vote, the resolution to limit war powers over Venezuela, and in late October State briefed congressional aides on the status of forces agreement.

The National Assembly approved on Tuesday the 3rd, unanimously and on second reading, 11 more articles of the power reform, with the rules for private companies.

EVENTO

Articles 14 through 24 put private companies on par with Corpoelec in their obligations and give them the right to economic remuneration and to grid access through a toll to be set by a new Electricity System Superintendency, whose head the Executive freely appoints and removes. Corpoelec may create subsidiaries and sign public-private partnership, rehabilitation and maintenance contracts without ceding ownership of the assets, and those agreements do not pass prior labor, environmental or tax liabilities to the new operators.

VE Análisis

On October 28 the Assembly had approved the first 13 articles; with these there are 24, and debate was deferred after article 24. The changes answer two questions for anyone weighing entry: whether they get paid and who sets the price of using the grid, and whether they inherit Corpoelec’s debts. The first is left to a superintendency the Executive appoints and removes. GE Vernova said on October 28 it will not start its grid work until it receives the state’s first payment.
