GL 47B — Sale of U.S.-Origin Diluents to Venezuela

Scope

Authorizes the export, sale, supply and transport of U.S.-origin diluents to Venezuela in transactions involving the Government of Venezuela and PdVSA. As of August 27, 2026, the contract must only route disputes to the U.S., U.K., France, or Singapore; it no longer needs to be governed by U.S. law. Supersedes GL 47A.

Conditions

  • ·Todo contrato de estas transacciones con el Gobierno de Venezuela, PdVSA o entidades de PdVSA debe estipular que las disputas relativas al contrato se resuelvan en EE.UU., Reino Unido, Francia o Singapur. Desde el 27-ago-2026 ya NO se exige que el contrato se rija por la ley de un estado o jurisdicción de EE.UU.: la FAQ 1268 precisa que el requisito toca la sede del procedimiento, no el derecho aplicable al contrato.

El 27 de agosto de 2026 OFAC emitió la GL 47B, que reemplaza a la GL 47A del 10 de junio. Se elimina la exigencia de que el contrato con el Gobierno de Venezuela o con PdVSA se interprete conforme a la ley de un estado o jurisdicción de EE.UU.; permanece la de resolver disputas en EE.UU., Reino Unido, Francia o Singapur. Es la única de las ocho licencias enmendadas que no excluye a Rusia de su párrafo de prohibiciones: la exclusión alcanza a Irán, Corea del Norte y Cuba.
Implication
El diluyente es el insumo que decide cuánto crudo extrapesado de la Faja puede fluir y venderse. Bajar la fricción contractual del contrato de suministro toca directamente el volumen alcanzable, no una cifra abstracta de apertura. Para el proveedor estadounidense de nafta, la conversación con PdVSA deja de tener una cláusula que el comprador rechazaba de entrada.
Indicator to monitor
Si los contratos que se firmen a partir de ahora eligen ley venezolana, ley inglesa o una tercera, y si el foro pactado es arbitraje institucional en una de las cuatro sedes admitidas o litigio ante tribunales. El primer contrato conocido bajo el nuevo marco fija la plantilla que seguirán los demás. En paralelo: si OFAC repite el gesto sobre las licencias que quedaron fuera de esta ola, y si el anexo de la GL 50C incorpora alguna empresa nueva —hasta hoy repite las mismas seis.

General License No. 47B — Authorizing the Sale of U.S.-Origin Diluents to Venezuela

(a) Transactions ordinarily incident and necessary to the export, sale, supply, delivery, or transportation of U.S.-origin diluents to Venezuela, involving the Government of Venezuela and PdVSA, are authorized, provided contracts require dispute resolution proceedings to occur in the U.S., U.K., France, or Singapore.

(b) Does not authorize: non-commercial payment terms, debt swaps, payments in gold, or digital-currency/petro payments; transactions involving Iran, the DPRK, or Cuba, or a joint venture with such persons; unblocking of blocked property except as provided; or blocked vessels.

(e) Effective August 27, 2026, General License No. 47A, dated June 10, 2026, is replaced and superseded in its entirety by this General License No. 47B.

A Canadian oil company set out on August 24 the six steps it took to enter Venezuelan crude: a U.S. subsidiary, registration with the investment agency, exclusivities, data packages and a field visit. Five it took alone. For the sixth it states that it partners "with entities benefiting from the updated U.S. sanctions regime."
