Decree 5,364 and private property: what Article 6 actually authorises

Article 6 authorises the temporary occupation of private buildings and land. What the law requires, what the decree omits, and what an owner can do.

Published July 22, 2026

Decree 5,364, which declared a national state of emergency after the 24 June double earthquake, authorises in its Article 6 the temporary occupation of private buildings and plots of land, and the requisition of goods and services. It is a power of the executive, not an order of dispossession: four weeks after publication, no occupation or requisition has been documented under that article.

What is anomalous is what the decree does not say. Temporary occupation already existed in Venezuelan law, tied to four guarantees: a written resolution, prior notice, a defined term, and compensation. Decree 5,364 keeps the figure and reproduces none. This guide separates what Article 6 authorises from what it does not, distinguishes three concepts public conversation has merged into one, and pinpoints where the real risk lies.

Delcy Rodríguez sets a year-end deadline for the law opening Corpoelec's power grid to private companies

The bill letting private companies into generation, transmission and distribution has been waiting for its second reading since June 2. Before the country's largest business federation, the acting president said it will pass before the year is out.

Petrodelta and Cabimas: two displaced partners in Venezuela and one treaty left

Pacific Coast Energy already runs the fields of two joint ventures whose private partners say they still hold their 40%. What each can claim outside Venezuela turns on its company’s nationality: the Dutch one lost its treaty protection in 2023; the Spanish one keeps it, with ownership that will be hard to prove.

GL 48D — Supply of Goods and Services to Venezuela

Authorizes the supply from the U.S. or by a U.S. person of goods, technology, software or services for oil, gas and petrochemical exploration, development and production —including maintenance and repair of equipment—, and for electricity generation, transmission, storage and distribution in Venezuela. As of September 28, 2026, the petrochemical annex lists methanol. The formation of new joint ventures remains outside the license. Supersedes GL 48C.

Venezuela productive sector August 2026: the gateway waits on paperwork, not on construction

The Maiquetía terminal opening set for August 24 did not happen and that day's drill closed with no date. The September 1 in circulation sits in reservation systems, not in an official act: what is missing is slot assignment, and United already moved its route to January 2027.
